2018 has been a great year for Indian judiciary as Supreme court took important steps to ensure a new significant legal principle or concept by giving landmark judgments, few among those are as follows :
• Section 377 Verdict: India’s top court decriminalizes homosexuality in a landmark verdict
• Adultery is no longer a crime: Supreme Court scrapped Section 497 of the Indian penal code
• Triple talaq isn’t constitutional
• Supreme Court verdict on the reservation quotas for job promotions
• Passive euthanasia- The right to die with dignity is a fundamental right
• Aadhar isn’t mandatory, but voluntary for citizens to submit.
This year the Supreme Court has again started working effectively to consolidate a better position of the judiciary. Today I'll be discussing with you few of its important judgments of the day:
CRIMINAL-
Supreme Court has observed that, though conviction can solely be based on dying declaration, corroborative evidence may be required when there is doubt as to whether the victim was in a fit state of mind to make the statement.
CRIMINAL- Section 138 of the NI Act :
Supreme Court has observed that a complainant in a cheque bounce case is bound to explain his financial capacity, when the same is questioned by the accused, by leading evidence to that effect.
CRIMINAL- Rafale deal :
Supreme Court has dismissed the preliminary objections raised by Centre against using privileged documents for considering review petitions in Rafale case.
PROPERTY-
Supreme Court has observed that mere financial assistance to buy a property cannot be the sole determinative factor/circumstance to hold the transaction as benami in nature.
MOTOR VEHICLE -
Supreme Court has held that, in the case of a motor accident where there is the death of a person, who is a bachelor, it is the age of deceased which should be taken into account for calculating the multiplier, not that of dependents.
